Field Sobriety Tests: Are They Always Accurate?

When a police officer suspects a driver of being under the influence, one of the first steps is often a field sobriety test. These tests are designed to help officers decide if a driver may be impaired. However, while they are widely used, field sobriety tests are not always accurate. Many factors can affect the results and lead to unfair charges or arrests.

What Are Field Sobriety Tests?

Field sobriety tests are physical and mental exercises that officers use to check coordination, balance, and focus. The three most common tests are the Horizontal Gaze Nystagmus (HGN), where you follow a moving object with your eyes, the Walk-and-Turn, and the One-Leg Stand. These are meant to show signs of impairment, such as poor balance or trouble following directions.

Factors That Affect Accuracy

Even though these tests are standardized, many things can affect their accuracy. Uneven roads, poor lighting, or bad weather can make the tests harder to perform. Health issues like inner ear problems, anxiety, fatigue, or certain medications can also cause someone to fail a test even if they haven’t been drinking.

Another factor is the officer’s judgment. Field sobriety tests rely heavily on observation, which means the results can be subjective. An officer might mistake nervousness or clumsiness for signs of impairment. This can lead to wrongful DWI arrests.

Can You Refuse a Field Sobriety Test?

In New York, drivers can refuse to take field sobriety tests, though this may lead to other consequences. Officers may still make an arrest based on their observations or request a breath or blood test.
